The Senate met at 11:00 a.m. pursuant to adjournment and was called to order by President Pro Tempore Duncan.

SENATE RESOLUTION 234

Senator West offered the following resolution:

WHEREAS, Board members from the John Goodwin Tower Center for Political Studies at Southern Methodist University are gathering at the State Capitol on February 17, 2009; and

WHEREAS, Offering intellectual discourse, lively debate, and thought-provoking research, the Tower Center supports teaching and research programs in international studies and national security policy; the center reaches out to the greater community through its sponsorship of conferences, seminars, and public lectures by world leaders; and

WHEREAS, The program was named in honor of former three-term United States Senator John Goodwin Tower, the first elected Republican to hold a United States Senate seat from Texas since Reconstruction; and

WHEREAS, Reaching students from middle school through postdoctoral studies, the center places a special emphasis on undergraduate teaching and works to encourage students' interest in public service; enabling scholars to pursue research in such topics as domestic and foreign policy and the global economy, the program contributes to informed debate on the public policy challenges that confront our nation and the world; and

SENATE RESOLUTION 227

Senator Lucio offered the following resolution:

WHEREAS, The Senate of the State of Texas takes pleasure in welcoming the visiting delegation from Catholic Charities and salutes the members of the organization for their many good works over the years; and

WHEREAS, Catholic Charities is present in more than 20 locations in Texas; Catholic Charities extends to persons of all races, religions, and socioeconomic backgrounds faith-based and tangible assistance, with the goal of helping them reach self-sufficiency; and

WHEREAS, Among the many programs and services provided by Catholic Charities and Parish Social Ministry programs are adoption, basic personal-living needs, counseling, disaster response, education and enrichment, housing, food banks, and health, refugee, immigration, and social support; in 2008 alone the organization aided more than 400,000 individuals; and

WHEREAS, As a part of the Catholic Church's mission to respect the dignity of all people, Catholic Criminal Justice Ministers serve as chaplains in jails and prisons throughout the state of Texas, working to assist in the rehabilitation of the convicted and the reintegration of ex-offenders into society; and

WHEREAS, In addition to its Catholic Charities and Criminal Justice Ministry programs, Catholic Social Action Ministry is a continuing advocate of social justice and seeks to empower communities through action and education with the guiding principle of ensuring basic human dignity for all; now, therefore, be it

RESOLVED, That the Senate of the State of Texas, 81st Legislature, hereby extend a warm welcome to the members of the Catholic Charity and Justice delegation on the occasion of their visit to the State Capitol and commend all those associated with the organization for their ongoing efforts to make a positive difference in the lives of others; and, be it further

SENATE RESOLUTION 228

Senator Lucio offered the following resolution:

WHEREAS, The Senate of the State of Texas is pleased to pay tribute to the Most Reverend Raymundo J. Peña, Bishop of the Diocese of Brownsville, on the grand occasion of his 75th birthday; and

WHEREAS, Well known for his warmth and generosity of spirit, this distinguished clergyman has devoted his time and energy unselfishly to the people of his diocese since 1995; and

WHEREAS, Bishop Peña was born February 19, 1934; he was ordained to the priesthood on May 25, 1957, in Corpus Christi, and he has served his church with wisdom and humility in various positions through the years, including auxiliary bishop of the Archdiocese of San Antonio and bishop of the Diocese of El Paso; and

WHEREAS, In May, 1995, Pope John Paul II asked Bishop Peña to move to the Diocese of Brownsville, containing one of the largest and fastest-growing Catholic populations in the United States; on August 7, 1995, Bishop Raymundo J. Peña was installed as the fifth bishop of Brownsville; and

WHEREAS, An accomplished scholar and theologian, he has ministered faithfully to the temporal and spiritual needs of innumerable people; and

WHEREAS, Bishop Peña is a beloved and respected member of his community, and he is noted for his courage, his compassion, and his enthusiasm for living each day to the fullest; now, therefore, be it

RESOLVED, That the Senate of the State of Texas, 81st Legislature, hereby recognize the Most Reverend Raymundo J. Peña, Bishop of the Diocese of Brownsville, as a treasured citizen of our state and extend to him best wishes for a joyful 75th birthday; and, be it further

SENATE RESOLUTION 215

Senator Wentworth offered the following resolution:

WHEREAS, The Texas Senate is pleased to recognize February 17, 2009, as Viva San Antonio Day at the State Capitol and welcome the visiting delegation from the Alamo City; and

WHEREAS, The history of San Antonio can be traced back to 1691, when a group of Spanish explorers and missionaries came upon a river and named it San Antonio, in honor of St. Anthony, whose feast day was being celebrated; and

WHEREAS, The city was founded in 1718 by Father Antonio Olivares; he established Mission San Antonio de Valero, which would become etched in the annals of history in 1836 as the Alamo, the site where 189 brave individuals held the mission for 13 days against an army of some 4,000 Mexican soldiers; and

WHEREAS, The cry "Remember the Alamo" became the rallying point of the Texas Revolution; today, the Alamo is a shrine and museum and is widely recognized as the cradle of Texas liberty; and

WHEREAS, San Antonio became formally incorporated in 1837, when the fledgling Republic of Texas granted the city a charter; the city has since retained its sense of history and tradition while carefully blending in cosmopolitan progress; it has served and continues to serve as a crossroads and a meeting place, where the rich sounds and flavors of Native Americans, Old Mexico, Germans, the Wild West, African Americans, and the Deep South mingle and merge; and

WHEREAS, The city has a proud military heritage; great military figures like Pershing, Stillwell, Krueger, LeMay, Chennault, and Eisenhower served at San Antonio military institutions, including Fort Sam Houston, the headquarters for the Fifth U.S. Army and the home of the U.S. Army Medical Command and the Brooke Army Medical Center; in addition, San Antonio is the site of Lackland Air Force Base, the largest training wing in the U.S. Air Force, and Brooks City-Base, an innovative master-planned research and technology center; and

WHEREAS, Recent years have brought remarkable economic development to San Antonio as its skilled workforce, excellent institutions of public and higher education, and quality of life have attracted some important corporate business and industry to the city; and

WHEREAS, Millions of visitors a year delight in the discovery of San Antonio; in addition to the Alamo, highlights include La Villita, San Fernando Cathedral, San Antonio Missions Trail, and the famed Paseo del Rio, better known as "The Riverwalk"; among the other attractions that make San Antonio one of the top tourist destinations in the country are Sea World San Antonio and the Six Flags Fiesta Texas theme park as well as the PGA Tour Valero Texas Open, the Alamo Bowl, and the four-time world champion San Antonio Spurs; and

WHEREAS, In April 2009, the city will once again celebrate Fiesta San Antonio, the biggest 10-day party in the state; first held 118 years ago, the event was founded by a group of ladies who decorated horse-drawn carriages for a parade in front of the Alamo and battled with flower blossoms instead of bullets to honor the heroes of the Alamo and the Battle of San Jacinto; and

WHEREAS, San Antonio is truly one of the treasures of the Lone Star State, and Viva San Antonio Day provides a welcome opportunity to honor the city and its many fine residents; now, therefore, be it

RESOLVED, That the Senate of the 81st Texas Legislature hereby recognize February 17, 2009, as Viva San Antonio Day at the State Capitol and extend to the members of the visiting delegation best wishes for a memorable visit.

SENATE CONCURRENT RESOLUTION 19

The Presiding Officer laid before the Senate the following resolution:

WHEREAS, The Legislature of the State of Texas is pleased to join the Texas Renal Coalition in recognizing February 17, 2009, as Kidney Day at the State Capitol; and

WHEREAS, The Texas Renal Coalition is a leader in the prevention and mitigation of the risks, effects, and burdens of chronic kidney diseases; the coalition forms partnerships with state agencies and volunteer groups to support victims and to educate the public about the disease; and

WHEREAS, The coalition monitors health policies for dialysis and transplant patients, offers educational programs to improve public awareness about the disease, and acts as a clearinghouse for information related to legislative issues; and

WHEREAS, The coalition is a participant on the Chronic Kidney Disease Task Force and works with the Texas Department of State Health Services and other organizations to educate health care professionals about the advantages of early screening, diagnosis, and treatment of chronic kidney disease and end stage renal disease; and

WHEREAS, Across the state, members of the Texas Renal Coalition, volunteers, physicians, trained health care providers, organizational partners, patients, and family members are doing an outstanding job in their efforts to provide the best care for kidney patients and those at risk for kidney disease, and they all deserve recognition for their dedication and valuable services; now, therefore, be it

RESOLVED, That the 81st Legislature of the State of Texas hereby proclaim February 17, 2009, as Kidney Day at the State Capitol and extend a warm welcome to kidney patients and kidney health care providers and advocates who are visiting Austin today; and, be it further

WHEREAS, Access to high-quality prekindergarten allows parents to work without incurring the expense of child care, thereby enabling individuals to contribute their skills to the Texas workforce and to increase their financial stability; and

WHEREAS, Supporters of the expansion of prekindergarten programs recognize that children need a nurturing, structured environment early on to develop the study skills and work habits that are essential to a successful academic career and to greater opportunity; now, therefore, be it

SENATE RESOLUTION 231

Senator Uresti offered the following resolution:

WHEREAS, The Senate of the State of Texas is pleased to join the citizens of Brewster County and Texans across the state in celebrating February 17, 2009, as Brewster County Legislative Day at the State Capitol; and

WHEREAS, The largest county in Texas, Brewster County is located in the Trans-Pecos region of West Texas and is home to Big Bend National Park, the largest park in the state; and

WHEREAS, The first Europeans to explore the area were members of Spanish expeditions in the 16th century; the rugged, mountainous terrain of the area discouraged settlement until after the Civil War, when the development of the cattle industry and the arrival of the railroads, along with the presence of the United States Army, made the area safe and profitable for settlers; and

WHEREAS, The discovery of mercury in the late 19th century touched off a mining boom in the county, and by 1905, the Chisos Mining Company was supplying 20 percent of the nation's mercury; the burgeoning cattle industry, along with mercury mining, formed the backbone of the area's economy for many years; and

WHEREAS, Today, Brewster County serves as a prime tourist destination, with Big Bend National Park drawing more than 250,000 visitors annually; the World Championship Chili Cookoff in Terlingua brings chili cooks from around the state and nation to participate; and

WHEREAS, The citizens of Brewster County are rightly proud of the county's rich history and its many contributions to our state; now, therefore, be it

RESOLVED, That the Senate of the State of Texas, 81st Legislature, hereby commend the citizens of Brewster County and extend to the county's delegation a sincere welcome to Austin for Brewster County Legislative Day at the State Capitol; and, be it further

WHEREAS, Located in the southeast corner of Tarrant County in the Dallas-Fort Worth Metroplex, Mansfield is one of the fastest-growing cities in the nation; and

WHEREAS, Home to major employers such as Mouser Electronics, a Wal-Mart Supercenter, Methodist Mansfield Medical Center, LyondellBasell, and Siméus Foods, the City of Mansfield enjoys a lower cost of living than most major metropolitan areas, and it is one of the safest communities in the region; and

WHEREAS, The City of Mansfield is blessed with an outstanding educational system, with the Mansfield Independent School District being one of the fastest-growing districts in the nation; four district campuses have been recognized as exemplary by the Texas Education Agency, and Mansfield High School was selected as a National Model High School by the International Center for Leadership in Education; and

WHEREAS, Proud residents of Rockwall County are gathering in Austin on February 17, 2009, to celebrate Rockwall County Day at the State Capitol; and

WHEREAS, Situated on the gently rolling Blackland Prairie of North Texas, the region was originally inhabited by the Caddo and Cherokee; the first European resident, John O. Heath, settled on the East Fork of the Trinity River in 1846; Rockwall County was established in 1873, taking its name from an underground rock formation discovered by farmers who were digging a well; and

WHEREAS, An important center for cotton production for many years, Rockwall County today boasts a population of nearly 70,000 people who enjoy being in close proximity to the Dallas-Fort Worth Metroplex while savoring the relaxed and comfortable way of life in the county's many thriving communities; and

WHEREAS, The City of Rowlett, on the shore of Lake Ray Hubbard, is emerging as an important regional center and will be the site of the intersection of the eastern extension of the President George Bush Turnpike and the new Blue Line Extension of DART Commuter Rail; another prosperous lakeside city is Heath, which

has recently revised and adopted a comprehensive plan that reaffirms its commitment to service, orderly growth, transportation, development, and the preservation of the time-honored values cherished by its residents; and

WHEREAS, In 2008, voters in the City of Fate passed a home rule charter by an overwhelming majority; this development promises to make that community an even more important component of the county's economy; positive change and preparation for the years ahead are also taking place in the City of McLendon-Chisholm; this is the newest city in Rockwall County but was formed from two of the oldest area communities, McLendon and Chisholm, both of which date back to the mid-1800s; and

WHEREAS, Rockwall, which is being designated as a Main Street City in 2009, is a fast-growing suburban community that continues its dedication to preserving its heritage and its pleasant, family-friendly atmosphere; as part of that effort, the city's Historic Preservation Advisory Board has worked with residents and civic leaders to develop a preservation plan for the Old Town Rockwall Historic District, which will help the district to remain the vibrant heart of the city; and

WHEREAS, Residents of Royse City are also making it a priority to carry forth the small-town way of life that has long characterized their community; designated as a Main Street City in 2008, the town has established a Heritage Committee and ordinance and design guidelines in order to revitalize the historical district, and it also benefits from a strong chamber of commerce that supports local businesses; and

WHEREAS, Throughout Rockwall County, citizens have done an outstanding job of maintaining long-cherished hometown values and an inspiring sense of community even as they look forward to the opportunities of the future, and their ongoing success in these endeavors has made the county an exceptional place to live, work, and raise a family; now, therefore, be it

WHEREAS, The first meeting of this esteemed association took place on Augusti14, 1874; association members adopted their preamble, calling for sheriffs to assist one another in the execution of laws, in the discharge of their duties against criminals, and in the protection of the citizens in their respective counties and throughout the state; the group has continued to follow the dictates of this mission; and

WHEREAS, The office of sheriff is one of the oldest forms of law enforcement; sheriffs in our state's 254 counties are elected to four-year terms, and each sheriff is a member of the Sheriffs' Association of Texas; in addition, more than 2,500 individuals are active members of the group, and more than 45,000 individuals are associate members; now, therefore, be it

WHEREAS, Located in the westernmost tip of the state, the City of El Paso combines a modern metropolis with the charm born of its Spanish origins; the area was named El Paso by the Spanish conquistador Don Juan de Onate because of the shallow place in the river where the colonists crossed en route to Santa Fe, New Mexico; and

WHEREAS, The arrival of the railroads in 1881 ushered in an era of prosperity, and El Paso became a flourishing frontier community that has developed into a significant industrial, commercial, and transportation city; and

WHEREAS, Today, semitrailers, trains, and planes transport manufactured goods through the border cities at the Pass, just as Spanish traders did in the 16th century when they guided ox-drawn carts along the Camino Real from Mexico City to Santa Fe; and

WHEREAS, With a population of nearly three-quarters of a million people, El Paso is the state's sixth-largest city and the nation's 22nd-largest; the largest American city on the 2,000-mile United States-Mexico border, it lies across the Rio Grande from Ciudad Juarez, Mexico's fifth-largest city, which has a population of over a million people; and

WHEREAS, Nearby Fort Bliss, which celebrated its 160th anniversary in 2008, is immersed in the biggest transformation in its history; its population is projected to increase 300 percent by 2012, and $5 billion is being invested in construction for new, top-of-the-line facilities for the incoming personnel and their families; and
